Is modding commercial use or non-commercial? - Reminiscity - 04-02-2014

Hello fellow modders! This question was on my mind a couple of years back when I started modding and I did some research and came to the simple conclusion that commercial use = when you profit, non-commercial = when you don't profit.

A few days back I did some research again to be sure because I found textures I wanted to use but they can only be used in non-commercial projects. I did a bit of reading and I'm not 100% sure that what I'm doing is non-commercial :S Because apparently, you can't also profit indirectly.

My scenario is the same as most of you guys'. Making a mod for Amnesia TDD. Ofc, no profit is being made. My interwebnetz alias is Reminiscity. I use that in everything like for example when I'm making music. If I would earn a buck or 2 of off my music in the future (cuz it's just a hobby of mine I don't profit at all) would that be an indirect profit because my name Reminiscity is being seen in the mod and can be considered a commercial for my music or maybe a game I make in the future?

You don't have to go into detail a simple answer like "Modding for amnesia is non-commercial and you don't have to worry about future profit in your name" or "Modding for amnesia is commercial don't fuck with law boy"

Modding for amnesia is non-commercial and you don't have to worry about future profit in your name

BUT! If you use models etc you need to credit the person that created the model.

Im pretty sure that's how it works.

"Commercial" use is something which you ask people to pay for them to be able to use the whatever it is you are making.

"Non-commercial" is something where people do not need to pay for something to be able to use it, but it can still earn you donations or ad-revenue.

Although, some people might consider donations and/or ad-revenue as "commercial" use.

money made commercially isnt based off name. Its based off WHAT is making money. Because your name is in the credits for a mod and your making money off of music YOU made that doesnt mater. If you sell the mod thats making money commercially using the mod.

Its not per name but per whats sold.

Basically, as long as you don't require players to pay you in order to download your mod, you probably won't need to worry about this. If what you're doing is free, even if you're making some money off it on the side, it's not commercial.
